Agreement - Terms and Conditions
All purchases of services or products through Airsealed Marketing are governed by our Terms of Sale Agreement. Please read it carefully before making a purchase. If you do not wish to accept our Terms of Sale, please do not purchase any services or products through our site. (When we refer to "Airsealed Marketing," "we," or "our" such references include Airsealed Marketing and our affiliated companies.)
PURCHASES
When you click on the "SUBMIT" or similar button on a product or service screen, you agree to purchase the products and services indicated, in accordance with the terms and conditions included on the relevant screens, and in accordance with this agreement.
WAIVER AND LIMITATION OF LIABILITY
You hereby acknowledge that the warranty provided herein and the accompanying obligations and liabilities of Airsealed Marketingare exclusive and you hereby waive all other remedies, warranties, guarantees or liabilities, express or implied, arising by law or otherwise, whether or not occasioned by the negligence of Airsealed Marketing. You acknowledge by your use of Airsealed Marketing products that your use of the products and any reliance upon them is at your sole risk, and that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with Airsealed Marketing's products.
Airsealed Marketing HAS PRICED ITS PRODUCTS UPON THE UNDERSTANDING, AND YOU HEREBY ACKNOWLEDGE THE UNDERSTANDING, THAT Airsealed Marketing WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY FORM OF CONSEQUENTIAL, INCIDENTAL, STATUTORY, PUNITIVE, EXEMPLARY OR INDIRECT DAMAGES OF WHATEVER KIND OR TYPE ARISING FROM ANY TYPE OF COMMERCIAL, BUSINESS, ENVIRONMENTAL, TORT, WARRANTY, CONTRACT, STRICT LIABILITY OR OTHER CAUSES ARISING DIRECTLY OR INDIRECTLY FROM OR IN CONNECTION WITH ANY PRODUCT AND/OR ITS USE.
Follow all instructions and heed all warnings accompanying any product ordered from the Site.
YOU AGREE NOT TO JOIN IN ANY LAWSUIT WITH ANOTHER PERSON OR SERVE AS A CLASS REPRESENTATIVE OF ANY CLASS ACTION LAWSUIT AGAINST Airsealed Marketing ARISING OUT OF YOUR PURCHASE OR USE OF PRODUCTS ORDERED VIA THE SITE.
Airsealed Marketing is a concierge service. Airsealed Marketing is NOT pharmacy. Airsealed Marketing is not reselling products/medicines but providing a service at fees that include the cost of product, local management, shipping and handling.
1. Airsealed Marketing will only supply Products under these Terms and Conditions, which are conclusive and non-negotiable.
2. Airsealed Marketing assumes no liability for the use of any products supplied. Liability rests with the purchaser to use products under the guidance and prescription of a licensed physician.
3. Airsealed Marketing takes no responsibility for confirming the importation requirements, including any prescription requirements and regulations of the purchaser and the purchasers country of origin. All products are shipped:
- at the full risk of the purchaser.
- in agreement of holding Airsealed Marketing reserved towards any legal action, that might be brought against the purchaser if not acting in accordance with the regulations and importation laws of the destination country.
4. Purchaser warrants that they hold Airsealed Marketing free of any and all legal action and prosecution. This includes any entrapment procedures that may be perpetrated or attempted by law enforcement and government agents and/or their agencies.
5. Purchaser affirms they are of legal age and capacity.
6. Airsealed Marketing does not offer medical advice; all information is supplied on an educational basis and should not be construed to replace that of a physician. All translations are offered on a best effort basis. Any opinions stated are not necessarily those of Airsealed Marketing. Where applicable, in accordance with Title 17 U.S.C. Section 107, material is distributed without profit to those who have expressed a prior interest in receiving the information for research and educational purposes.
7. In the event an order is detained and confiscated by foreign customs, the loss rests completely with the purchaser, unless order is returned to Airsealed Marketing in which case order will be reshipped.
8. Airsealed Marketing will fully guarantee delivery only if all bellow conditions are met:
- a valid medical prescription is submitted to be sent with shipment
- the purchaser has provided correct shipping information
- import laws in destination country allow import of ordered product
9. Airsealed Marketing takes no responsibility for lost orders, wrong deliveries or product damage caused by the Postal Service.
10. If incorrect shipping information is provided by the purchaser, the order might be miss delivered and/or returned to sender. Airsealed Marketing takes no responsibility for order losses caused by this miss delivery.
11. Customer/purchaser accepts that shipments may be delayed due to various postal conditions for a total transit time of 10 weeks. Customer/purchaser will not make any claims (including reshipment and charge backs) to an order before 10 weeks time has passed since order has originally shipped.
12. Prices are subjected to change according to International currency rates and changes in cost prices without further notice.
13. Availability of products is subjected to change without further notice.
14. Airsealed Marketing takes no responsibility for dispatch delays caused by delivery problems of manufacturer/supplier, or any other delays caused by a third party. Nor does Airsealed Marketing take responsibility for shipment delays caused by holidays or the Postal Service.
15. In the event wrong products are received, the correct products will be reshipped free of charge, provided the wrong products are returned unopened and in re-salable condition.
16. In the event products arrive damaged due to improper packaging by Airsealed Marketing, products will be reshipped free of charge if a claim is made and proof of improper packaging is given.
17. Returns are accepted only if products are proven to be unusable, excluding section (15).
18. Refunds are accepted only if products are proven to be unusable.
19. Order cancellations after order has been shipped are not accepted.
20. For any type of payment used to pay for an order, customer agrees not to make disputes or claims on payment, for situations as described in sections (2), (3), (4), (5), (6), (7), (8), (9), (10) and (11) or for any other reasons that would violate any other term and condition in our Disclaimer. Any charge back, dispute or payment claim that is attempted in contradiction of this Disclaimer is considered fraudulent. In addition, any future orders with Airsealed Marketing will be refused completely.
INDEMNIFICATION
YOU AGREE TO DEFEND, INDEMNIFY AND HOLD COMPLETELY HARMLESS Airsealed Marketing FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, COSTS, AND EXPENSES, INCLUDING ATTORNEYS? FEES, ARISING FROM OR RELATED TO YOUR USE OF THE PRODUCTS PURCHASED VIA THE SITE.
AIRSEALED MARKETING RESERVES THE RIGHTS TO ONLY PROCESS AND SHIP ORDERS IF THE FOLLOWING TERMS AND CONDITIONS ARE ACCEPTED WITH A CONFIRMED AGREEMENT FROM THE PURCHASER. THE PURCHASER AGREES TO ADHERE TO ALL THESE COMPANY REGULATIONS WHEN PLACING AND ORDER WITH US.
